Foreword

Loom cares about the privacy of its customers, and in particular about their personal data. Loom collects and uses personal data because it may be necessary or useful for the use of its services, the delivery of its products, or the use of its website. Loom hopes that this policy will help you understand our commitments to protecting your privacy and confidentiality.

The data controller responsible for the processing of your personal data is the simplified joint-stock company (société par actions simplifiée) Loom (842 991 655 RCS Paris). You may at any time access your data, rectify it, request its deletion, or object to processing on legitimate grounds relating to your particular situation, by contacting our Data Protection Officer ("DPO"), Mr Clément Potier, by email (hello@loom.fr), or by post at the following address: Loom, 4 rue Barbette, 75003 Paris, France. Continuing to use the Loom website constitutes acceptance of this personal data protection policy. Please read this policy carefully.

A) Your rights We are committed to respecting the confidentiality of your personal data and to guaranteeing the exercise of your rights. You may exercise your rights free of charge by emailing us at hello@loom.fr, or by post, stating the reason for your request and the right you wish to exercise. Any request to exercise the rights of access, rectification, deletion or restriction of processing must be accompanied by a copy of the requester's identity document. Regardless of the purpose or legal basis under which we process your data, you are in particular entitled to: (i) Right of access: the right to be informed of, and to request access to, the personal data processed by Loom; (ii) Right of rectification: the right to ask Loom to change or update your personal data where it is inaccurate or incomplete; (iii) Right of erasure: the right to ask Loom to permanently delete your personal data insofar as it is no longer necessary for the purpose for which we may have needed to process it; (iv) Right of restriction: the right to ask Loom to temporarily or permanently stop processing all or part of your personal data; (v) Right to object: the right to object at any time to the processing of your personal data for personal reasons or for marketing purposes; (vi) Right to data portability: the right to ask Loom for a copy of your personal data in electronic format, and the right to transmit this personal data via a third-party service; (vii) Right not to be subject to automated decision-making: the right not to be subject to a decision based solely on automated decision-making, including profiling, where the decision would produce legal effects concerning you or similarly significantly affect you.

Lastly, we inform you of your right to lodge a complaint with the relevant data protection supervisory authority, in particular: the Commission Nationale de l'Informatique et des Libertés – CNIL, the French data protection authority (https://www.cnil.fr/fr/plaintes/internet); or the authority of the country in which the relevant retail company is established (http://ec.europa.eu/justice/article-29/structure/data-protection-authorities/index_en.htm)

B) What information is collected? As part of your registration and use of the services offered by Loom, we collect information in order to offer you the best possible experience. Personal data is collected directly from you when you use our website (creating an account or placing an order) or when you subscribe to our newsletter.

Depending on the case, Loom collects the following categories of data: (i) Identification data: postal address, email address, phone number, surname, first name; (ii) Order data: payment method, detailed history of your transactions, etc.; (iii) Usage data: services subscribed to, products used, means of connection, etc.; (iv) Customer relationship tracking data: requests for assistance or after-sales service, newsletter subscriptions, correspondence with the customer, etc.; (v) Data from participation in surveys, job applications or other activities that may require information about you.

When we ask you to enter your personal data to enable you to access one of the features or services of our website, please note that some fields will be marked as mandatory, as this is data we need to provide the service in question or to allow you to access that feature. As a result, if you decide not to provide us with this data, your registration as a user may not be able to be completed successfully, or you may not be able to make use of these services or features.

C) How is this data collected? Information is collected automatically when you use the Loom website, when you sign up for our newsletter, or when you take part in one of our surveys.

Loom collects the following categories of data: (i) Registration data: when you register, we may collect the data mentioned above in point B); (ii) Geolocation data: when you use the Loom website, we may collect information about your approximate or precise location, as determined by data such as your IP address or your mobile device's GPS. (iii) Cookies and similar technologies: when you use the Loom website, in order to provide optimal browsing for all users, we automatically collect connection and device data, even if you have not created a Loom Account. The publisher may place a cookie on the user's device. Please note that all this data is statistical in nature and does not identify any particular individual. This cookie stores information relating to browsing on the site (date, pages, times), as well as any data entered by users during their visit (searches, login, email, password). These cookies are intended to be stored on the user's device for a variable period that may not exceed 13 months, and may be read and used by the publisher during a later visit by the user to this site. Users may block, change the retention period of, or delete this cookie via their browser interface (usually: tools or options / privacy or confidentiality). In such a case, browsing on this site will not be optimised. If systematically disabling cookies in the user's browser prevents them from using certain services or features provided by the publisher, this malfunction shall not in any way constitute damage to the user, who shall not be entitled to any compensation as a result.

D) How is this data used? Loom strives to collect the minimum amount of data and to limit its use. Loom uses, stores and processes the aforementioned data in order to manage your registration as a user of our website, to implement and perform the purchase or services contract, to operate our customer service, for commercial purposes (newsletter), and to improve our customer interfaces, with the aim of:

  • Supporting, improving and developing the operation and performance of our services and products;
  • Diagnosing problems and identifying security risks, errors or necessary improvements to our services;
  • Detecting and preventing fraud and abuse of our Services and systems;
  • Collecting overall statistics on the use of our services and products;
  • Creating and maintaining a more secure environment of trust;
  • Understanding and analysing how you use our services and which products and services are most relevant to you;
  • Sending communications about products and services, for commercial prospecting purposes, in the form of email;

Whenever an electronic communication is sent for commercial prospecting purposes, the recipient has the option to choose to stop receiving such communications in future via an unsubscribe link. In addition, it is possible at any time to send an email to the following address: hello@loom.fr to request that these commercial communications be stopped.

The use of data and information as described above is authorised by the regulations applicable to the protection of personal data. In most cases, this processing of personal data for commercial prospecting purposes is based on the legitimate interest of Loom SAS.

E) How is this data shared? For the purposes of managing and performing the services provided by Loom, the data processed, which you have requested or authorised, may be transferred to subcontractors, partners and trusted third parties (logistics companies, financial institutions, email sending platforms).

As a rule, your data is kept in France and remains with Loom and its host OVH. None of the data processed and collected by Loom is transferred to a third country outside the European Union, or to a country that does not offer a level of protection considered adequate by the European Commission. On request, it may also be transferred to persons and authorities whose right of access to personal data is recognised by law, regulations, or provisions issued by authorities empowered by law.

F) How is this data stored, secured and deleted? Loom makes its best efforts to protect your personal data and thereby limit the risks of loss, damage or misuse. Data is processed electronically and/or manually and, in all cases, in such a way as to ensure its security, protection and confidentiality with regard to its level of sensitivity, through administrative, technical and physical measures designed to prevent unauthorised loss, theft, use, disclosure or alteration. In particular, it is duly backed up and protected with restricted access for the period during which liability could arise as a result of the processing, in accordance with the regulations in force at any given time.

Despite the security measures taken, Loom cannot guarantee the transmission and integrity of data sent to third parties via the website, and disclaims all liability in this regard.

You acknowledge in particular the constraints and risks inherent in the use of the Internet, and you hereby undertake to take all preventive measures yourself to keep your personal data confidential (including any account passwords required to use the services offered by Loom).

Loom keeps your data only for as long as necessary to provide you with services and products in an optimal and commercially essential manner. Accordingly, data relating to (i) your customer account (user account on our website or in store) will be kept for as long as you remain a registered user/customer (i.e. until you decide to delete your account); (ii) data relating to the implementation, application and performance of the purchase contract will be kept for as long as necessary to manage the purchase, including any returns, warranties, complaints or claims associated with the purchase of the product in particular; and (iii) data relating to marketing actions will be kept until you unsubscribe or cancel your newsletter subscription. In certain cases, we will only process the data until a time you have decided, as is the case for payment (card) data that you have asked us to keep for possible future purchases.

At your request, Loom will delete and anonymise your data so that you can no longer be identified, unless the law authorises or requires us to keep certain personal data, in particular in the following cases: (i) An unpaid debt, a claim, an unresolved dispute: data will be kept until the matter is resolved; (ii) Legal, tax, audit and accounting obligations: data will be kept for the period required by applicable law; (iii) Legitimate business interests: fraud or the security of our Customers.

G) Changes to the privacy policy This Privacy Policy was last updated on 13 October 2020. We reserve the right to amend it at any time in order to provide up-to-date information on how we collect and process data.
