ARTICLE 1 - Scope of Application
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Loom (“the Seller”) to consumers and non-professional buyers (“the Customers” or “the Customer”) who wish to purchase the products offered for sale by the Seller (“the Products”) on the website www.loom.fr.
In particular, they specify the terms and conditions for ordering, payment, delivery, and the handling of any returns of Products ordered by Customers.
These General Terms and Conditions of Sale may be supplemented by special terms and conditions, which are set forth on the website, prior to any transaction with the Customer.
These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions, including, in particular, those applicable to in-store sales or sales through other distribution and marketing channels.
They are available at any time on the website www.loom.fr and, if necessary, will take precedence over any other version or any other conflicting document.
Since these General Terms and Conditions of Sale may be subject to future changes, the version applicable to the Customer’s purchase is the one in effect on the website as of the date the order is placed.
ARTICLE 2 - Products Offered for Sale

The main features of the Products—including specifications, illustrations, and information regarding the Products’ dimensions or capacity—are presented on the website www.loom.fr.
The Customer is required to review these terms before placing any order.
The selection and purchase of a Product are the sole responsibility of the Customer.
The photographs and graphics displayed on the website www.loom.fr are not binding and do not constitute a basis for liability on the part of the Seller.
The Customer is required to review the description of each Product to learn about its features, key characteristics, and delivery times.
Contractual information is provided in French and is confirmed no later than the time the Customer confirms the order.
Products Featured on the Website www.loom.fr are offered for sale in the following countries: France, Belgium, Luxembourg, and Switzerland.
For orders shipped to a country other than mainland France, the Customer is the importer of the applicable Product(s).
For all Products shipped outside the European Union and the French overseas departments and territories, the price will automatically be calculated excluding taxes on the invoice.
Customs duties, other local taxes, import duties, or state taxes may be applicable. These will be borne by the Customer and are the Customer’s sole responsibility.

Product offers are subject to availability, as specified at the time the order is placed.

In accordance with the French Data Protection Act of January 6, 1978, as strengthened and supplemented by the GDPR (General Data Protection Regulation), which took effect on May 25, 2018, the Customer has the right, at any time, to access, correct, object to the processing of, erase, and request the portability of all of their personal data by writing—via mail and providing proof of identity—to the Seller’s address listed above.
The Customer’s confirmation of the order constitutes acceptance, without restriction or reservation, of these General Terms and Conditions of Sale.
The Customer acknowledges that he or she has the legal capacity to enter into a contract and purchase the Products offered on the website www.loom.fr.
ARTICLE 5 - Orders
5-1. Placing an Order
It is the Customer’s responsibility to select the Products they wish to order on the website www.loom.fr, in accordance with the following terms:

The Customer may review the details of their order and the total price, and correct any errors before confirming acceptance. It is the Customer’s responsibility to verify the accuracy of the order and to immediately report or correct any errors.
An order is placed on the website www.loom.fr when the Customer accepts these General Terms and Conditions of Sale by checking the box provided for that purpose and confirms the order. This confirmation implies acceptance of these General Terms and Conditions of Sale in their entirety, as well as the general terms and conditions of use for the website www.loom.fr.
The sale is final only after the Seller sends the Customer confirmation of the order’s acceptance via email, which must be sent without delay after the Seller has received payment in full of the purchase price and the full down payment due.
Any order placed, accepted by the Customer, and confirmed by the Seller, under the terms and conditions described above, on the website www.loom.fr constitutes the formation of a distance contract between the Customer and the Seller.
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions entered into with the Customer.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment for a previous order.
The Customer can track the status of their order through the various emails sent by the Seller following the order placed on www.loom.fr.
5-2. Modifying the Order
Once confirmed and accepted by the Seller, under the terms described above, the order cannot be modified.
5-3. Order Cancellation
Orders may be canceled by the Customer, except when exercising the right of withdrawal or in cases of force majeure:

Before 11:59 a.m. for orders placed between 6:00 a.m. and 11:59 a.m.,

Before 4:59 a.m. for orders placed between 12:00 p.m. on D-1 and 4:59 a.m.
ARTICLE 6 - Rates
Products are provided at the current prices listed on the website www.loom.fr at the time the Seller records the order. Prices are listed in euros, including tax.
The prices take into account any discounts that the Seller may offer on the website www.loom.fr.
These rates are fixed and non-negotiable during their period of validity, as indicated on the website www.loom.fr; the Seller reserves the right, outside this validity period, to modify prices at any time. They do not include shipping costs, which are billed as an additional charge, under the terms specified on the website www.loom.fr and calculated prior to placing the order.
The payment requested from the Customer is equal to the total purchase amount, including these fees.
ARTICLE 7 - Terms of Payment
The price is payable in full on the day the Customer places the order, via secure payment by credit card (Carte Bancaire, Visa, MasterCard).
Payment by credit card is irrevocable, except in the event of fraudulent use of the card. In such cases, the Customer may request that the payment be canceled and the corresponding amounts refunded.
Payment by check is not allowed.
Payment data is transmitted securely using the SSL protocol.
ARTICLE 8 - Deliveries
Products ordered by the Customer will be delivered to mainland France (and to the following countries: Belgium, Luxembourg, Switzerland) within 3 business days from the date the order is shipped (this corresponds to the shipping time indicated on the Product page, plus the processing and transit time) — to the address provided by the Customer when placing the order on the website www.loom.fr.
Delivery consists of the transfer to the Customer of physical possession or control of the Product.
Unless there are special circumstances or one or more Products are unavailable, the ordered Products will be delivered in a single shipment.
The Seller agrees to use its best efforts to deliver the products ordered by the Customer within the timeframes specified above. However, these timeframes are provided for informational purposes only. If the ordered Products have not been delivered within “10 days” of the estimated delivery date, for any reason other than force majeure or the Customer’s fault, the sale may be rescinded upon the Customer’s written request under the conditions set forth in Articles L 216-2, L 216-3, and L 241-4 of the Consumer Code. Any amounts paid by the Customer will then be refunded no later than fourteen days following the date of termination of the contract, excluding any compensation or deductions.
In the event that the delivered Product does not conform to specifications, the Seller agrees to remedy the issue or refund the Customer, as set forth in the section titled “Seller’s Liability—Warranty.”
The Seller assumes the risks of shipping and is required to reimburse the Customer for any damage caused during shipping.
Deliveries are handled by an independent carrier (Colissimo) to the address provided by the Customer when placing the order and to which the carrier can easily gain access.
The Customer is required to inspect the condition of the delivered products. The Customer has 48 hours from the time of delivery to submit, via email to hello@loom.fr, any reservations or claims regarding non-conformity or apparent defects in the delivered Products (e.g., a damaged or already opened package, etc.), along with all relevant supporting documentation (including, in particular, photographs). After this period has elapsed, and if these formalities have not been followed, the Products will be deemed to be in compliance and free from any apparent defects, and no claim may be validly accepted by the Seller.
The Seller shall, at its own expense and as soon as possible, refund or replace any delivered Products for which the Customer has duly proven nonconformities or apparent or hidden defects, in accordance with the conditions set forth in Articles L 217-4 et seq. of the French Consumer Code and those set forth in these General Terms and Conditions of Sale (see “Warranties,” in particular).
ARTICLE 9 - Transfer of Ownership - Transfer of Risk
Title to the Seller’s Products shall not pass to the Customer until the Customer has paid the full purchase price, regardless of the delivery date of such Products.
Regardless of the date of transfer of ownership of the Products, the transfer of the risk of loss or damage to the Products shall not take place until the Customer physically takes possession of the Products. The Products therefore travel at the Seller’s risk.
ARTICLE 10 - Right of Withdrawal
In accordance with applicable law, the Customer has fourteen days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to provide a reason or pay a penalty, for the purpose of an exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 30 days of placing the order with the Seller.
Returns must be in their original condition and include all components (packaging, accessories, instruction manual, etc.) so that the items can be resold as new, along with the purchase receipt.
Damaged, soiled, or incomplete products will not be accepted for return.
The right of withdrawal may be exercised online using the withdrawal form available on the website www.loom.fr/retours, in which case the Seller will immediately provide the Customer with an acknowledgment of receipt in a durable medium, or by any other unambiguous statement expressing the intention to withdraw.
If the right of withdrawal is exercised within the aforementioned time limit, the Seller is responsible for the return shipping costs.
The refund will be issued within 2 days of the Seller’s logistics center (Logtex) receiving the returned merchandise.
ARTICLE 11 - Exceptional Refusal to Sell
The Seller reserves the exceptional right to cancel or refuse any order from a Customer in the event of obvious or repeated abuse of the right of withdrawal, systematic returns, or excessive or disproportionate use of the After-Sales Service (SAV), when such behavior results in excessive financial or logistical costs for Loom.
In such a case, the Customer will be notified by email of the Seller’s decision, along with the specific reasons leading to the exceptional refusal to sell. This decision is made in accordance with legal provisions, without discrimination, and exclusively for the purpose of protecting the Seller’s economic and operational interests."
ARTICLE 12 - Seller's Liability - Warranty
The products sold on the website www.loom.fr comply with current French regulations and are designed for non-professional use.
If a product is received that is defective, damaged, or does not match the order placed, the Customer must notify the Seller by email (hello@loom.fr) within 48 hours of delivery of the Products and return the defective Products in the condition in which they were received, along with all components (accessories, packaging, instructions, etc.).
Refunds (full or partial) or replacements for defective products will be processed as follows:

Minor manufacturing defect found upon receipt of the product (loose thread, slightly loose stitching, etc.): a flat fee of up to €20 to cover the cost of alterations

Major manufacturing defect discovered upon receipt of the product (holes, stains that do not come out in the wash, etc.): full refund of the product's price or exchange for a new product, while supplies last

Usure précoce (< 1 ans) du produit dans le cadre d'un port habituel (trous au coude, couture défaite, déchirure, décoloration...) : si réparable, forfait de 10€ à 20€ pour remboursement des frais de retouche. si non réparable, envoi d'un bon d'achat de la valeur du produit neuf.

Usure du produit < 1 ans si Loom n'est pas directement responsable (taches, accrocs, traces de transpiration...) : pas de remboursement ni de renvoi de produit

Product wear and tear after more than 1 year of normal use (holes in the elbows, tears, come-undone seams, discoloration, etc.): no refund or return of the product
The Seller will be responsible for return shipping costs.
Refunds for Products deemed non-compliant or defective will be issued as soon as possible and no later than “10” days from the date the returned merchandise is received by the Seller’s logistics center (Logtex).
The refund will be credited to the Customer's bank account.
The Seller shall not be held liable in the following cases:

failure to comply with the laws of the country to which the products are delivered, which the Customer is responsible for verifying,

in the event of misuse, use for commercial purposes, negligence, or failure to maintain the Product on the part of the Customer, as well as in the event of normal wear and tear of the Product, an accident, or force majeure.
The Seller’s warranty is, in any event, limited to the replacement or refund of Products that do not conform or are defective.
ARTICLE 13 - Protection of Personal Data
Pursuant to Law No. 78-17 of January 6, 1978, as amended by Law No. 2018-493 of June 20, 2018, please be advised that the personal data requested from the Customer is necessary, in particular, for processing the Customer’s order and issuing invoices.
This information may be shared with the Seller's partners, if any, who are responsible for fulfilling, processing, managing, and paying for orders.
The processing of information provided through the website www.loom.fr complies with legal requirements regarding the protection of personal data; the information system used ensures optimal protection of this data.
In accordance with applicable national and European regulations, the Customer has the right to access, modify, correct, object to, request portability of, and restrict the processing of information concerning him or her at any time.
This right may be exercised under the conditions and in accordance with the procedures set forth on the website www.loom.fr.
ARTICLE 14 - Intellectual Property
The content of the website www.loom.fr is the property of the Seller and its partners and is protected by French and international intellectual property laws.
Any reproduction, in whole or in part, of this content is strictly prohibited and may constitute an act of copyright infringement.
ARTICLE 15 - Force Majeure
In the event of unforeseeable changes in circumstances at the time the contract is entered into, in accordance with the provisions of Article 1195 of the Civil Code, the Party that did not agree to assume the risk of excessively onerous performance may request that the other party renegotiate the contract.
ARTICLE 16 - Force Majeure
The Parties shall not be held liable if the failure to perform or any delay in the performance of any of their obligations, as described herein, results from a force majeure event, as defined in Article 1218 of the Civil Code.
ARTICLE 17 - Governing Law - Language
These General Terms and Conditions of Sale and any transactions arising therefrom are governed by French law.
They are written in French. If they are translated into one or more languages, only the French text shall be considered authentic in the event of a dispute.
ARTICLE 18 - Disputes
Any disputes arising from purchase and sale transactions entered into pursuant to these General Terms and Conditions of Sale—including disputes concerning their validity, interpretation, performance, termination, consequences, and repercussions—that cannot be resolved between the seller and the customer shall be submitted to the competent courts in accordance with general law.
The Customer is informed that, in any event, he or she may seek conventional mediation, in particular through the Consumer Mediation Commission (Consumer Code Art. L 612-1) or through existing sector-specific mediation bodies, whose contact information is available on the website https://cm2c.net, or to any alternative dispute resolution method (such as conciliation) in the event of a dispute.

If the dispute must be brought before the courts, it is noted that, pursuant to Article L 141-5 of the Consumer Code,theconsumer may, at his or her discretion, bring the matter before either one of the courts with territorial jurisdiction under the Code of Civil Procedure or the court of the place where he or she resided at the time the contract was entered into or the harmful event occurred.
It should also be noted that, in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has established an Online Dispute Resolution platform to facilitate the independent, out-of-court resolution of online disputes between consumers and businesses in the European Union.
If a customer believes that a violation of the General Data Protection Regulation has occurred, the customer may authorize an association or organization listed in Section IV of Article 43 ter of the 1978 Data Protection Act to seek redress against the data controller or processor before a civil or administrative court or before the National Commission for Information Technology and Civil Liberties.
ARTICLE 19 - Precontractual Information - Customer Acceptance
When a natural person (or legal entity) places an order on the website www.loom.fr, such action constitutes full and unconditional acceptance of these General Terms and Conditions of Sale and an obligation to pay for the Products ordered. This is expressly acknowledged by the Customer, who waives, in particular, the right to rely on any conflicting document that would be unenforceable against the Seller.
