Terms and Conditions of Sale

ARTICLE 1 - Scope of application

These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Loom ("the Seller") to consumers and non-professional buyers ("the Customers or the Customer"), wishing to acquire the products offered for sale by the Seller ("the Products") on the website www.loom.fr.

They specify in particular the conditions of ordering, payment, delivery and management of any returns of the Products ordered by the Customers.

These General Terms and Conditions of Sale may be supplemented by specific conditions, set out on the website, before any transaction with the Customer.

These General Terms and Conditions of Sale apply to the exclusion of all other conditions, and in particular those applicable to sales in store or through other distribution and marketing channels.

They are accessible at any time on the website www.loom.fr and shall prevail, where applicable, over any other version or any other contradictory document.

As these General Terms and Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.

ARTICLE 2 - Products offered for sale

The Products offered for sale on the website www.loom.fr are the products listed on the following page: https://www.loom.fr/collections/tous-les-vetements 

The main characteristics of the Products, and in particular the specifications, illustrations and indications of the dimensions or capacity of the Products, are presented on the website www.loom.fr.

The Customer is required to read them before placing any order.

The choice and purchase of a Product are the sole responsibility of the Customer.

The photographs and graphics presented on the website www.loom.fr are not contractual and cannot engage the Seller's liability.

The Customer must refer to the description of each Product to learn its properties, essential characteristics and delivery times. 

Contractual information is presented in French and confirmed at the latest when the Customer validates the order.

The Products presented on the website www.loom.fr are offered for sale for the following territories: France, Belgium, Luxembourg, Switzerland. 

In the case of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and the French overseas territories, the price will automatically be calculated exclusive of tax on the invoice.

Customs duties or other local taxes or import duties or state taxes may be payable. They are the sole responsibility of the Customer and are to be borne by them.

ARTICLE 3 - Validity period of the Product offer

Product offers are subject to available stock, as specified at the time the order is placed.

In accordance with the French Data Protection Act of 6 January 1978, strengthened and supplemented by the GDPR (General Data Protection Regulation) which came into force on 25 May 2018, the Customer has, at any time, a right of access, rectification, objection, erasure and portability of all their personal data by writing, by post and providing proof of identity, to the Seller's address indicated above.

Confirmation of the order by the Customer constitutes acceptance, without restriction or reservation, of these General Terms and Conditions of Sale.

The Customer acknowledges that they have the capacity required to enter into a contract and purchase the Products offered on the website www.loom.fr.

ARTICLE 5 - Orders

5-1 . Placing the order

It is up to the Customer to select the Products they wish to order on the www.loom.fr website, in the following manner: 

  • Browsing the site www.loom.fr

  • Adding the chosen product(s) to the basket by clicking the "Add to basket" button on each product page

  • Confirming the shopping basket by clicking "Proceed to payment" on the order summary page.

  • Entering the buyer's details ahead of delivery on the "Information" and "Delivery" pages of www.loom.fr

  • Payment for the basket by entering bank details on the "Payment" page of www.loom.fr

The Customer has the option of checking the details of their order, its total price, and correcting any errors before confirming their acceptance. It is their responsibility to check that the order is correct and to report or rectify any error immediately.

An order is recorded on the www.loom.fr website when the Customer accepts these General Terms and Conditions of Sale by ticking the box provided for that purpose and confirms their order. This confirmation implies acceptance of all of these General Terms and Conditions of Sale as well as the general terms of use of the www.loom.fr website.

The sale is only final once the Seller has sent the Customer confirmation of acceptance of the order by email, which must be sent without delay, and once the Seller has collected the full price and once the Seller has collected the full deposit due.

Any order placed, validated by the Customer and confirmed by the Seller, under the conditions and in accordance with the terms described above, on the website www.loom.fr constitutes the formation of a contract concluded remotely between the Customer and the Seller.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment of a previous order.

The Customer can track the progress of their order through the various emails sent by the Seller following the order placed on www.loom.fr.

5-2 . Modifying the order

Once confirmed and accepted by the Seller, under the conditions described above, the order cannot be modified.

5-3 . Cancelling the order

Orders may be cancelled by the Customer outside the exercise of the right of withdrawal or in cases of force majeure:

  • Before 11:59 a.m. for orders placed between 6:00 a.m. and 11:59 a.m.,

  • Before 4:59 a.m. for orders placed between 12:00 p.m. the previous day and 4:59 a.m. 

ARTICLE 6 - Prices

The Products are supplied at the prices in force shown on the website www.loom.fr at the time the order is recorded by the Seller. Prices are expressed in Euros, including tax.

The prices take into account any discounts that may be granted by the Seller on the website www.loom.fr.

These prices are firm and non-revisable during their period of validity, as indicated on the website www.loom.fr, the Seller reserving the right, outside this period of validity, to change prices at any time. They do not include shipping charges, which are billed in addition, under the conditions indicated on the website www.loom.fr and calculated prior to the order being placed.

The payment requested from the Customer corresponds to the total amount of the purchase, including these charges.

ARTICLE 7 - Payment terms

The price is payable in cash, in full on the day the order is placed by the Customer, via secure payment by bank card (Carte Bancaire, Visa, MasterCard).

Payment by bank card is irrevocable, except in the event of fraudulent use of the card. In such cases, the Customer may request cancellation of the payment and a refund of the corresponding amounts.

Payment by cheque is not accepted.

Payment data is exchanged in encrypted form using the SSL protocol.

ARTICLE 8 - Deliveries

The Products ordered by the Customer will be delivered within mainland France (and to the following countries: Belgium, Luxembourg, Switzerland) within 3 working days from the dispatch of the order (this corresponds to the dispatch time shown on the Product page, to which the processing and shipping time is added) - to the address given by the Customer when placing the order on the website www.loom.fr.

Delivery consists of the transfer to the Customer of physical possession or control of the Product.

Except in special cases or if one or more Products are unavailable, the ordered Products will be delivered in a single shipment.

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the time frames specified above. However, these time frames are provided for guidance only. If the ordered Products have not been delivered within "10 days" after the indicative delivery date, for any reason other than force majeure or the Customer's own actions, the sale may be cancelled at the Customer's written request under the conditions provided for in articles L 216-2 L 216-3 L241-4 of the French Consumer Code. The sums paid by the Customer will then be refunded to them within fourteen days at the latest following the date the contract is terminated, excluding any compensation or deduction.

If the delivered Product is non-conforming, the Seller undertakes to remedy this or to refund the Customer, as set out in the article "Seller's Liability - Warranty".

The Seller bears the risks of transport and must refund the Customer in the event of damage caused during transport.

Deliveries are handled by an independent carrier (Colissimo), to the address given by the Customer when placing the order and which the carrier can easily access.

The Customer must check the condition of the delivered products. They have 48 hours from delivery to submit, by email to hello@loom.fr, any reservations or complaints regarding non-conformity or apparent defects in the delivered Products (for example, a damaged package that has already been opened, etc.), along with all relevant supporting documents (photos in particular). After this period, and if these formalities have not been complied with, the Products will be deemed to be conforming and free of any apparent defect, and no complaint may be validly accepted by the Seller.

The Seller will refund or replace, as quickly as possible and at its own expense, the delivered Products whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions set out in articles L 217-4 et seq. of the Consumer Code and those set out in these General Terms and Conditions of Sale (see warranties in particular).

ARTICLE 9 - Transfer of ownership - Transfer of risk

The transfer of ownership of the Seller's Products to the Customer will only take place once the latter has paid the price in full, regardless of the delivery date of the said Products.

Regardless of the date on which ownership of the Products is transferred, the transfer of the risks of loss and damage relating to them will only take place when the Customer physically takes possession of the Products. The Products therefore travel at the Seller's risk.

ARTICLE 10 - Right of withdrawal

In accordance with the legal provisions in force, the Customer has a period of fourteen days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to give reasons or pay a penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 30 days of the order being placed with the Seller.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.), allowing them to be resold as new, together with the purchase invoice.

Products that are damaged, soiled or incomplete will not be accepted for return.

The right of withdrawal may be exercised online, using the withdrawal form available on the website www.loom.fr/retours, in which case an acknowledgement of receipt on a durable medium will be sent immediately to the Customer by the Seller, or by any other unambiguous statement expressing the intention to withdraw.

Where the right of withdrawal is exercised within the aforementioned period, the return costs are borne by the Seller.

The refund will be made within 2 days of the returned goods being received by the Seller's logistics centre (Logtex).

ARTICLE 11 - Exceptional refusal to sell

The Seller reserves the exceptional right to cancel or refuse any order from a Customer in the event of manifest or repeated abuse of the right of withdrawal, systematic returns, or excessive or disproportionate use of the After-Sales Service, where such behaviour results in excessive financial or logistical costs for the company Loom.
In such a case, the Customer will be informed by email of the Seller's decision as well as the precise reasons that led to the exceptional refusal of sale. This decision is made in accordance with legal provisions, without discrimination, and exclusively with the aim of protecting the Seller's economic and operational interests.

ARTICLE 12 - Seller's Liability - Warranty

The Products sold on the website www.loom.fr comply with the regulations in force in France and have performance levels compatible with non-professional use. 

If a product is received defective, damaged, spoiled, or not matching the order placed, the Customer must inform the Seller by email (hello@loom.fr) within a maximum of 48 hours from the delivery of the Products and return the defective Products in the condition in which they were received, with all elements (accessories, packaging, instructions, etc.).

The refund (full or partial) or replacement of defective products will be carried out according to the following terms: 

  • Minor manufacturing defect found on receipt of the product (a loose thread, a slightly undone seam, etc.): a flat rate of up to £20 to cover alteration costs 

  • Major manufacturing defect found on receipt of the product (holes, a stain that won't come out in the wash, etc.): refund of the product at full price or exchange for a new product, subject to available stock 

  • Early wear (< 1 year) of the product with normal use (holes at the elbow, undone seams, tears, fading, etc.): if repairable, a flat rate of £10 to £20 to cover alteration costs; if not repairable, a voucher for the value of the new product will be sent.

  • Product wear < 1 year if Loom is not directly responsible (stains, snags, sweat marks, etc.): no refund or replacement product

  • Product wear > 1 year with normal use (holes at the elbow, tears, undone seams, fading, etc.): no refund or replacement product

Return costs will be borne by the Seller. 

Refunds for Products deemed non-compliant or defective will be issued as quickly as possible and no later than "10" days from receipt of the returned goods by the Seller's logistics centre (Logtex).

The refund will be made by credit to the Customer's bank account.

The Seller cannot be held liable in the following cases: 

  • failure to comply with the legislation of the country to which the products are delivered, which it is the Customer's responsibility to check,

  • in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as well as in the event of normal wear and tear of the Product, accident or force majeure.

The Seller's warranty is, in any event, limited to the replacement or refund of Products that do not conform or are affected by a defect.

ARTICLE 13 - Protection of personal data

Pursuant to law 78-17 of 6 January 1978 as amended by law no. 2018-493 of 20 June 2018, it is recalled that the personal data requested from the Customer is necessary in particular for processing their order and issuing invoices.

This data may be shared with any of the Seller's partners responsible for the fulfilment, processing, management and payment of orders.

The processing of the information provided through the www.loom.fr website meets the legal requirements regarding the protection of personal data, the information system used ensuring optimal protection of this data.

In accordance with the national and European regulations in force, the Customer has a permanent right of access, modification, rectification, objection to portability and restriction of processing with regard to the information concerning them.

This right may be exercised under the conditions and according to the procedures set out on the www.loom.fr website.

ARTICLE 14 - Intellectual property

The content of the www.loom.fr website is the property of the Seller and its partners and is protected by French and international intellectual property laws.

Any total or partial reproduction of this content is strictly prohibited and may constitute an offence of counterfeiting.

ARTICLE 15 - Unforeseeability

In the event of a change in circumstances that were unforeseeable when the contract was concluded, in accordance with the provisions of article 1195 of the Civil Code, the Party that did not agree to bear the risk of excessively onerous performance may request a renegotiation of the contract from its co-contracting party.

ARTICLE 16 - Force majeure

The Parties cannot be held liable if the non-performance or delay in the performance of any of their obligations, as described herein, results from an event of force majeure within the meaning of article 1218 of the Civil Code.

ARTICLE 17 - Applicable law - Language

These General Terms and Conditions of Sale and the transactions arising from them are governed by French law.

They are drafted in French. Should they be translated into one or more languages, only the French text shall prevail in the event of a dispute.

ARTICLE 18 - Disputes

Any disputes to which the purchase and sale transactions concluded under these general terms and conditions of sale may give rise, concerning their validity, interpretation, performance, termination, consequences and after-effects, and which could not be resolved between the seller and the customer, will be submitted to the competent courts under ordinary law.

The Customer is informed that they may in any event resort to conventional mediation, in particular through the Consumer Mediation Commission (French Consumer Code, art. L 612-1) or through the existing sector-specific mediation bodies, whose details appear on the website https://cm2c.net, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

If the dispute must be brought before the courts, please note that under Article L 141-5 of the French Consumer Code: the consumer may, at their choice, in addition to one of the courts with territorial jurisdiction under the Code of Civil Procedure, bring the matter before the court of the place where they were living at the time the contract was concluded or where the harmful event occurred .

We also remind you that, in accordance with Article 14 of Regulation (EU) No 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court resolution of online disputes between consumers and traders in the European Union.

A customer who finds that a breach of the General Data Protection Regulation has been committed may mandate an association or body mentioned in section IV of Article 43 ter of the French Data Protection Act of 1978, in order to obtain redress against the data controller or processor before a civil or administrative court or before the French National Commission for Information Technology and Civil Liberties (CNIL).

ARTICLE 19 - Pre-contractual information - Customer acceptance

For a natural (or legal) person, placing an order on the website www.loom.fr entails full and unreserved adherence to and acceptance of these General Terms and Conditions of Sale and an obligation to pay for the ordered Products, which is expressly acknowledged by the Customer, who waives, in particular, any right to rely on any conflicting document, which would be unenforceable against the Seller.
