General Terms and Conditions of Sale

ARTICLE 1 - Scope These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by Loom ("the Seller") to consumers and non-professional buyers ("the Customers or the Customer"), wishing to purchase the products offered for sale by the Seller ("the Products") on the website www.loom.fr. They set out, in particular, the terms of ordering, payment, delivery and management of any returns of Products ordered by Customers. These General Terms and Conditions of Sale may be supplemented by specific conditions, set out on the website, prior to any transaction with the Customer. These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions, in particular those applicable to sales in store or through other distribution and sales channels. They are accessible at any time on the website www.loom.fr and shall prevail, where applicable, over any other version or any conflicting document. As these General Terms and Conditions of Sale may be amended at a later date, the version applicable to the Customer's purchase is the one in force on the website on the date the order is placed.

ARTICLE 2 - Products offered for sale The Products offered for sale on the website www.loom.fr are the products listed on the following page: https://www.loom.fr/collections/tous-les-vetements The main characteristics of the Products, and in particular the specifications, illustrations and dimension or capacity information for the Products, are presented on the website www.loom.fr. The Customer is required to review these before placing any order. The choice and purchase of a Product is the sole responsibility of the Customer. The photographs and graphics presented on the website www.loom.fr are not contractually binding and shall not engage the Seller's liability. The Customer is required to refer to the description of each Product in order to be aware of its properties, essential characteristics and delivery times. Contractual information is presented in French and is confirmed at the latest when the Customer validates the order. The Products presented on the website www.loom.fr are offered for sale in the following territories: France, Belgium, Luxembourg, Switzerland. In the case of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned. For all Products shipped outside the European Union and French overseas territories (DOM-TOM), the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable. These shall be borne by, and are the sole responsibility of, the Customer.

ARTICLE 3 - Validity period of the Product offer Product offers are subject to availability of stock, as specified when the order is placed.

ARTICLE 4 - Seller's contact details The Seller's contact details are as follows: Loom SAS RCS Paris 842 991 655 4 rue Barbette 75003 Paris, France hello@loom.fr In accordance with the French Data Protection Act (Loi Informatique et Libertés) of 6 January 1978, strengthened and supplemented by the GDPR (General Data Protection Regulation), which came into force on 25 May 2018, the Customer has, at any time, a right of access, rectification, objection, erasure and portability with respect to all of their personal data, by writing, by post and providing proof of identity, to the Seller's address mentioned above. Validation of the order by the Customer constitutes acceptance, without restriction or reservation, of these General Terms and Conditions of Sale. The Customer acknowledges having the legal capacity required to enter into a contract and purchase the Products offered on the website www.loom.fr.

ARTICLE 5 - Orders 5-1. Placing an order It is the Customer's responsibility to select on the website www.loom.fr the Products they wish to order, following these steps:

  • Browsing the site www.loom.fr
  • Adding the chosen product(s) to the cart by clicking the "Add to cart" button on each product page
  • Confirming the shopping cart by clicking "Proceed to checkout" on the order summary page.
  • Entering the buyer's details in preparation for delivery on the "Information" and "Shipping" pages of www.loom.fr
  • Paying for the cart by entering bank card details on the "Payment" page of www.loom.fr

The Customer may check the details of their order and its total price, and correct any errors, before confirming their acceptance. It is the Customer's responsibility to check the accuracy of the order and to report or correct any error immediately. An order is recorded on the website www.loom.fr once the Customer accepts these General Terms and Conditions of Sale by ticking the box provided for that purpose and confirms their order. This confirmation implies acceptance of these General Terms and Conditions of Sale in full, as well as the general terms of use of the website www.loom.fr. The sale is only final once the Seller has sent the Customer email confirmation that the order has been accepted, which must be sent without delay, and after the Seller has received payment of the full price and, where applicable, the full deposit due. Any order placed, validated by the Customer and confirmed by the Seller, under the conditions and in the manner described above, on the website www.loom.fr constitutes the formation of a distance contract between the Customer and the Seller. Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute concerning payment of a previous order. The Customer can track the progress of their order through the various emails sent by the Seller following an order placed on www.loom.fr.

5-2. Amending an order Once confirmed and accepted by the Seller, under the conditions described above, the order cannot be amended.

5-3. Cancelling an order Orders may be cancelled by the Customer, outside the exercise of the right of withdrawal or in the event of force majeure:

  • Before 11:59 for orders placed between 06:00 and 11:59,
  • Before 04:59 for orders placed between 12:00 on the previous day and 04:59

ARTICLE 6 - Prices Products are supplied at the prices in force shown on the website www.loom.fr at the time the order is recorded by the Seller. Prices are shown in Euros, inclusive of all taxes. Prices take into account any discounts granted by the Seller on the website www.loom.fr. These prices are fixed and cannot be revised during their period of validity, as indicated on the website www.loom.fr; the Seller reserves the right, outside this period of validity, to change prices at any time. They do not include shipping costs, which are invoiced separately, under the conditions indicated on the website www.loom.fr and calculated before the order is placed. The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

ARTICLE 7 - Payment terms The price is payable in cash, in full, on the day the Customer places the order, by secure payment by bank card (Carte Bancaire, Visa, MasterCard). Payment by bank card is irrevocable, except in the event of fraudulent use of the card. In that case, the Customer may request cancellation of the payment and the return of the corresponding amounts. In the event of payment by bank cheque, the cheque must be issued by a bank domiciled in mainland France or Monaco. Payment data is exchanged in encrypted form using the SSL protocol.

ARTICLE 8 - Delivery Products ordered by the Customer will be delivered in mainland France (and in the following countries: Belgium, Luxembourg, Switzerland, Portugal, Spain, Italy) within 3 to 5 working days of the order being shipped (this corresponds to the shipping time indicated on the Product page, plus processing and transit time) — to the address given by the Customer when placing the order on the website www.loom.fr. Delivery consists of the transfer to the Customer of physical possession or control of the Product. Except in special cases or where one or more Products are unavailable, ordered Products will be delivered in a single shipment. The Seller undertakes to make its best efforts to deliver the Products ordered by the Customer within the timeframes specified above. However, these timeframes are given for guidance only. If the ordered Products have not been delivered within "10 days" after the indicative delivery date, for any reason other than force majeure or an act of the Customer, the sale may be terminated at the Customer's written request, under the conditions set out in Articles L 216-2, L 216-3 and L 241-4 of the French Consumer Code. Sums paid by the Customer will then be refunded no later than fourteen days after the date the contract is terminated, excluding any compensation or deduction. In the event of non-conformity of the delivered Product, the Seller undertakes to remedy the situation or refund the Customer, as set out in the article "Seller's Liability - Warranty". The Seller bears the risks of transport and is required to refund the Customer in the event of damage caused during transport. Deliveries are handled by an independent carrier (Colissimo), to the address given by the Customer when placing the order and to which the carrier can easily gain access. The Customer is required to check the condition of the delivered products. The Customer has 48 hours from delivery to raise, by email to hello@loom.fr, any reservations or claims regarding non-conformity or apparent defects in the delivered Products (for example, a damaged parcel that has already been opened, etc.), together with all relevant supporting evidence (photos in particular). After this period, and failing compliance with these formalities, the Products will be deemed to conform and to be free of any apparent defect, and no claim can be validly accepted by the Seller. The Seller will refund or replace, as soon as possible and at its own expense, delivered Products whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions set out in Articles L 217-4 et seq. of the French Consumer Code and those set out in these General Terms and Conditions of Sale (see warranties, in particular).

ARTICLE 9 - Transfer of ownership - Transfer of risk Ownership of the Products transfers from the Seller to the Customer only once the Customer has paid the price in full, regardless of the date of delivery of the said Products. Regardless of the date of transfer of ownership of the Products, the transfer of risk of loss and damage relating to them will only take place once the Customer physically takes possession of the Products. The Products therefore travel at the Seller's risk.

ARTICLE 10 - Right of withdrawal In accordance with applicable legal provisions, the Customer has fourteen days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to give reasons or pay a penalty, for the purposes of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within 30 days of the order being placed with the Seller. Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.), allowing them to be put back on the market as new, accompanied by the purchase invoice. Damaged, soiled or incomplete Products will not be accepted for return. The right of withdrawal may be exercised online, using the withdrawal form available on the website www.loom.fr/retours, in which case an acknowledgement of receipt on a durable medium will be sent to the Customer immediately by the Seller, or by any other unambiguous statement expressing the wish to withdraw. Where the right of withdrawal is exercised within the above-mentioned period, return costs are borne by the Seller. The refund will be made within 2 days of receipt of the returned goods by the Seller's logistics centre (Logtex).

ARTICLE 11 - Seller's liability - Warranty Products sold on the website www.loom.fr comply with the regulations in force in France and have performance suited to non-professional use. If a Customer receives a defective, damaged or spoiled product, or one that does not match the order placed, the Customer must inform the Seller by email (hello@loom.fr) within a maximum of 48 hours of delivery of the Products, and return the defective Products in the condition in which they were received, with all accompanying elements (accessories, packaging, instructions, etc.). The refund (in full or in part) or replacement of defective products will be carried out as follows:

  • Minor manufacturing defect noted on receipt of the product (a loose thread, a slightly undone seam, etc.): a flat-rate amount of up to €20 to cover the cost of alterations
  • Major manufacturing defect noted on receipt of the product (holes, a stain that does not come out in the wash, etc.): full refund of the product or exchange for a new product, subject to stock availability
  • Early wear (< 1 year) of the product under normal wear conditions (holes at the elbow, an undone seam, a tear, discolouration, etc.): if repairable, a flat-rate amount of €10 to €20 to cover the cost of alterations; if not repairable, a gift card for the value of the new product will be sent.
  • Wear on a product < 1 year old where Loom is not directly responsible (stains, snags, marks from perspiration, etc.): no refund or return of product
  • Wear on a product > 1 year old under normal wear conditions (holes at the elbow, a tear, an undone seam, discolouration, etc.): no refund or return of product

Return costs will be borne by the Seller. Refunds for Products deemed non-conforming or defective will be made as soon as possible, and no later than 10 days from receipt of the returned goods by the Seller's logistics centre (Logtex). Refunds will be made by credit to the Customer's bank account. The Seller's liability cannot be engaged in the following cases:

  • failure to comply with the legislation of the country to which the products are delivered, which it is the Customer's responsibility to check,
  • in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as well as in the event of normal wear and tear of the Product, accident or force majeure.

The Seller's warranty is, in any event, limited to the replacement or refund of non-conforming or defective Products.

ARTICLE 12 - Protection of personal data Pursuant to Law 78-17 of 6 January 1978, as amended by Law No. 2018-493 of 20 June 2018, it is recalled that the personal data requested from the Customer is necessary, in particular, for processing their order and issuing invoices. This data may be communicated to any partners of the Seller responsible for the performance, processing, management and payment of orders. The processing of information communicated via the website www.loom.fr meets the legal requirements regarding the protection of personal data, and the information system used ensures optimal protection of this data. In accordance with national and European regulations in force, the Customer has a permanent right of access, modification, rectification, objection, portability and restriction of processing with regard to information concerning them. This right may be exercised under the conditions and in the manner defined on the website www.loom.fr.

ARTICLE 13 - Intellectual property The content of the website www.loom.fr is the property of the Seller and its partners and is protected by French and international intellectual property laws. Any full or partial reproduction of this content is strictly prohibited and may constitute an infringement offence.

ARTICLE 14 - Unforeseeability In the event of a change of unforeseeable circumstances at the time the contract is concluded, in accordance with the provisions of Article 1195 of the French Civil Code, the Party that has not agreed to bear the risk of excessively onerous performance may request a renegotiation of the contract from the other party.

ARTICLE 15 - Force majeure The Parties cannot be held liable if the failure to perform, or delay in performing, any of their obligations as described herein results from a case of force majeure, within the meaning of Article 1218 of the French Civil Code.

ARTICLE 16 - Applicable law - Language These General Terms and Conditions of Sale, and the transactions arising from them, are governed by French law. They are drafted in French. Should they be translated into one or more languages, only the French text shall prevail in the event of a dispute.

ARTICLE 17 - Disputes All disputes to which the purchase and sale transactions concluded under these general terms and conditions of sale may give rise, whether concerning their validity, interpretation, performance, termination, consequences or aftermath, and which could not be resolved between the seller and the customer, shall be submitted to the competent courts under ordinary law. The Customer is informed that they may, in any event, resort to conventional mediation, in particular with the Consumer Mediation Commission (C. consom. art. L 612-1) or with existing sector-specific mediation bodies, details of which are available on the website https://cm2c.net, or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute. A customer who finds that a breach of the General Data Protection Regulation has been committed may mandate an association or body referred to in Section IV of Article 43 ter of the 1978 Data Protection Act, in order to obtain redress against the data controller or processor before a civil or administrative court, or before the French data protection authority (CNIL).

ARTICLE 18 - Pre-contractual information - Customer's acceptance The fact that a natural person (or legal entity) places an order on the website www.loom.fr implies full and complete adherence to, and acceptance of, these General Terms and Conditions of Sale, and an obligation to pay for the Products ordered, which is expressly acknowledged by the Customer, who in particular waives the right to rely on any conflicting document that would not be enforceable against the Seller.
